Governor Issues Executive Order to Promote Job Creation

On October 17, 2011 Governor Martin O’Malley issued an executive
order designed to promote job creation in Maryland. The order states “all
State agencies must take additional steps to reduce regulatory burdens in order
to enable regulated businesses to focus on expansion and job creation and to
foster the growth of small businesses and new industries.” The order goes
on to instruct every State agency to “conduct a comprehensive review of its
regulations in order to determine whether any such regulations should be modified, streamlined, or replaced in order to reduce unnecessary regulatory burdens and promote economic growth and job creation.”

State agencies must report their findings to the Governor no later
than December 17, 2011. The M.M.C.A. will also be submitting a list of ideas to
the Governor and we are seeking input from our members. Please e-mail your

Army Corps Puts MDSPGP-4 Into Effect

The U.S. Army Corps of Engineers (Corps) published Special Public Notice 11-77 on its website today issuing the Maryland State Programmatic General Permit-4 (MDSPGP-4). According to the notice, MDSPGP-4 will be implemented and in full effect within the State of Maryland on October 1, 2011.

Severna Park Man Charged for Illegal Tree Clearing

BALTIMORE (AP) — Maryland’s attorney general says a 73-year-old

Severna Park man is the first to be charged criminally under the

state’s Critical Area law.

Attorney General Doug Gansler says William Clark was charged in

Anne Arundel County Circuit Court for illegally clearing trees. The

attorney general says Clark’s property sits on Sullivan Cove near

the Severn River and that the tree clearing violated critical area

and buffer regulations.

The attorney general announced the six misdemeanor charges

against Clark on Wednesday. Gansler says the charges were filed

after the Critical Area Commission for the Chesapeake and Atlantic

Coastal Bays referred the matter to his office for investigation.

The critical area program is designed to improve water quality

and protect wildlife habitat in tidal shoreline areas.

MDE Institutes New Permit Application Processing Procedures

Effective August 1st of this year, the Maryland Department of the Environment (MDE) has put into place new procedures for permit application review and related communication with applicants and / or their representing agent.

According to a recent announcment put out by MDE, “these procedures are intended to clarify the steps in the review process, promptly communicate the need for specific additional information, and add certainty to the permit process by adhering to the published permit turn around-times.”

Marine Contractor Registration

IMPORTANT NOTICE TO ALL MARINE CONTRACTORS…

In accordance with Senate Bill 382, as of December 31, 2010 all marine contractors performing or soliciting to perform marine contractor services in the State must be registered with the Maryland Department of the Environment. A person who violates this provision is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $10,000 and / or imprisonment not exceeding one year. Each day that a person a person performs or solicits to person marine contractor services without being properly registered could constitute a separate offense.
